The Civil Guard of the Region of Murcia has developed an investigation to clarify an alleged sexual assault committed in San Javier last Saturday, December 29, which has resulted in the arrest of the alleged victim of sexual assault as alleged perpetrator of crime of simulation of crime, after verifying that it was a false report.
During the night of last Saturday, December 29, a woman reported to the Benemérita having been the victim of a crime of sexual assault.
The woman informed the agents that the events took place in the urban area of ​​San Javier and that when she traveled on foot to her home, a man abducted her and sexually assaulted her.
Before the commission of this serious criminal act, civil guards of Prevention of Citizen Security opened the corresponding investigation planned for these cases with the purpose of gathering all the possible indications to clarify the crime.
As the investigation was developed, the agents detected a series of inconsistencies in the information provided by the victim who came to doubt its veracity, taking the strength of the hypothesis of the crime simulation.
Once all the necessary evidence has been obtained and verified that the complainant and alleged victim of sexual assault, presumably, had faked the crime, the Civil Guard has detained her as an alleged perpetrator of crime of simulation of crime.
The investigation shows that the woman who was now arrested, apparently, could have committed the crime of crime simulation with the intention of justifying the loss of a certain amount of money.
The detainee and the proceedings have been made available to the Court of Instruction of San Javier (Murcia).
The Civil Guard informs citizens of the criminal responsibility involved in reporting criminal acts that have never been committed, as well as the harm caused by the deportation of police officers to investigate false crimes that, in addition, usually generate great social alarm among the population, mainly when robberies are reported with violence committed by hooded people who use firearms.
The Criminal Code, in its article 457, establishes that, before any judicial or administrative officer who has the duty to investigate, pretend to be responsible or victim of a criminal offense or denounce a nonexistent one, provoking procedural actions, will be punished with the fine from six to twelve months.
