The Plenum of the Municipal Corporation, meeting in an extraordinary and urgent session, today unanimously agreed to all municipal political groups to appeal against the sentence handed down on 19 January by the Administrative Court of Contentious N ° 1 Cartagena in which the judge gives reason to Hidrogea in estimating the company's appeal against the agreement of the Plenary in which were approved the settlements of the annual water fee for the period 2002 to 2012, by which the City claims the Company concessionaire of the municipal water service, a total of € 11,443,679.38.
"Of course we will continue to defend the rights of the municipality," said the mayor, José Miguel Luengo who added that "although we respect the sentence, we believe that the rights of all citizens of San Javier may have been violated so we will continue to complain ".
The rest of the speakers spoke in the same vein.
The spokesman of the PSOE, José Ángel Noguera, defended "reaching even the European courts if necessary."
Matías Cantabella, of Ganar San Javier, was in favor "because the first thing is the interests of the neighbors".
The spokesman of Citizens-C's, Antonio Murcia considered "legitimate that the City Council defends the municipal interests," and the unassigned councilor, Santos Amor, who joined the unanimous vote in favor of the appeal, noted earlier "the difficulty of Appeal in the TSJ of Murcia, and possible payment of costs ".
The municipal political groups assumed the risk of paying the costs in their decision to continue claiming the settlements made by the municipal intervention, pointing out the difference that exists with the benefit that can be obtained if the resource prosper.
The City of San Javier claims 11.4 million euros from 2002 to 2012, period included in the sentence to be used, as the annual fee that according to the contract in force with Hidrogea was to pay the company when the number of meters was increased by Above 25% from 1994 when the contract was signed.
The canon settlements made by the company and rejected by the municipal intervention differ by an average of one million euros in each year.
The Company and City Council maintain other litigation for the same reason, still unresolved, corresponding to the liquidations of the years 2013 to 2016.
The Plenary began with a minute of silence in a sign of mourning and solidarity with the neighboring municipality of Torre Pacheco for the death of five young residents of the town in a traffic accident in which three other young people were injured.
